Finalising and maintaining the education, health and care plan (EHCP)

The final Education, Health and Care Plan (EHCP) sets out the rights of a child or young person with Specia Educational Needs (SEN).  The draft plan may go through many changes.

Once the local authority has consulted with parents and/or the young person about their draft EHCP, the local authority must finalise it. 

What will the final EHCP contain?

There is no national standard format for the EHCPs, however every plan must have certain sections

The final plan will name the type and name of the school or college. Once the school has been put into the plan, the school/college must admit the child or young person and put the educational provision into place. 

When a final EHCP is issued the parent/young person has a right of appeal to the SEND Tribunal and can appeal about: 

  • the description of the child or young person's SEN (section B),
  • the special educational provision (section F) specified in the EHCP, and/or
  • the name/type of school or college (section I) in the EHCP or the fact that no school/college is named. 

Do we have the right to appeal about the plan?

You can only appeal the health and/or social care sections if you are appealing any or all of the sections above.
